Cafarella was 18 when she received her first Gardasil injection in June 2018, according to the complaint. He then received a total of three injections of her HPV vaccine between June 2018 and May 2019.
Caffarella said the first two Gardasil injections went well, but after the third Gardasil injection, she began experiencing muscle aches, pain, fatigue, and irregular and uneven menstrual cycles. The Complaint alleges negligence, failure to warn, manufacturing defects, breach of warranty, and common law fraud.
February 2023 Gardasil Lawsuit Update
This lawsuit is consolidated with similar complaints pending in the federal Gardasil MDL (Multidistrict Litigation) established in August 2022. Given the general issues of fact and law presented in the claims, all Gardasil injection litigation will be centered before a United States District Court Judge. Robert J. Conrad of the Western District of North Carolina was responsible for the arbitrated discovery and pretrial proceedings.
As the parties continue to work with the court on the organizational structure of the Gardasil vaccine litigation through the remainder of early 2023, attorneys will investigate individuals who have experienced various complications related to Gardasil’s side effects, I continue to file lawsuits.

After coordinated discovery and pioneering trials in the federal MDL, if the parties do not reach a Gardasil Injection Settlement or another settlement of the litigation, Judge Conrad will seek to file a case with U.S. Districts across the country for individual trials.
